Legal framework and best practices for sending emails via FindMyLead

1. Purpose
This responsible sending policy defines the rules, obligations and best practices that any FindMyLead user commits to respect when sending email campaigns through our platform.
Acceptance of this policy is mandatory before any use of email sending features. It constitutes a contractual commitment between you and FindMyLead.
2. Applicable Legal Framework
Sending commercial emails in France and Europe is governed by:
- GDPR (EU Regulation 2016/679) — Articles 6 (legal bases), 7 (consent), 13-14 (information), 21 (right to object)
- ePrivacy Directive (2002/58/CE) — Framework for electronic prospecting
- French Postal and Electronic Communications Code (Art. L.34-5) — French transposition of the ePrivacy Directive
- CNIL Recommendations — Guidelines on B2B commercial prospecting
3. B2B Prospecting: Legitimate Interest
FindMyLead is a B2B prospecting platform. In accordance with the CNIL's position, B2B commercial prospecting may rely on legitimate interest (art. 6.1.f of GDPR), subject to compliance with the following conditions:
B2B Sending Conditions
- Recipients are professionals contacted at their professional email address
- The message relates to the recipient's professional role
- The prospecting subject is related to the recipient's professional activity
- A functional unsubscribe link is present in each email
- The sender's identity is clearly identifiable
4. Your Obligations as a User
Before Sending
- Ensure your recipients are professional contacts (no personal addresses @gmail.com, @yahoo.com, etc.)
- Ensure the content of your emails relates to your recipients' professional activity
- Never send misleading, illegal or abusive content
- Comply with rules on spam and unsolicited communications
During and After Sending
- Respect unsubscribes — Unsubscribe requests are automatically processed by FindMyLead via the global suppression list
- Never bypass suppression — It is forbidden to re-import contacts who have unsubscribed
- Monitor your rates — A high complaint rate or abnormal bounce rate will result in the suspension of your sends
5. FindMyLead Technical Mechanisms
FindMyLead implements the following mechanisms to ensure compliance with this policy:
- Mandatory unsubscribe link — Each template must contain the {{unsubscribeLink}} variable, automatically replaced by a functional link
- Global suppression list — Unsubscribed addresses are automatically excluded from all future sends
- Reputation monitoring — Tracking bounce rates, complaints and unsubscribes with automatic alerts
- Volume limitation — Sending quotas are calibrated to protect the reputation of all users
- Public unsubscribe page — Accessible at /opt-out, allowing anyone to request global unsubscription
6. First Contact and Information Obligation (Article 14 GDPR)
When a director's contact details are used for the first time in a prospecting campaign, the email sent must include:
- The identity of the data controller (the FindMyLead user sending the campaign)
- The data source : "Your professional contact details are publicly accessible through the Companies Register and your company's website"
- The legal basis : legitimate interest (article 6.1.f of GDPR) in the context of B2B prospecting
- A functional unsubscribe link
This notice is automatically added by FindMyLead in the footer of each first email. It cannot be removed by the user.
7. Managing Objections and Unsubscribes
Unsubscription works at the person level, not at the company level:
- When a director unsubscribes, they are added to a suppression list
- They will receive no further emails from that sender
- Suppression applies to all campaigns from the same sender
- The company remains contactable via other directors (unless they have also individually unsubscribed)
8. Sanctions
Non-compliance with this policy may result in:
- Immediate suspension of your sending capabilities
- Suspension or termination of your FindMyLead account
- A report to competent authorities (CNIL) in case of serious GDPR violation
You are personally responsible for the content of your campaigns and compliance with applicable regulations. FindMyLead acts as a technical sub-processor and cannot be held responsible for the abusive use of its platform.
