Rules for using the FindMyLead platform

1. Purpose
These Terms of Use (hereinafter "ToU") define the terms and conditions of access and use of the FindMyLead platform (hereinafter "the Service" or "the Platform"), accessible at https://findmylead.fr.
The Service is published by Thibaud Cathala, 53 RUE YVES LE COZ, 78000 Versailles, France (hereinafter "the Publisher").
FindMyLead is a B2B lead generation platform enabling professionals to identify, search and contact French companies for commercial prospecting purposes.
2. Acceptance of ToU
Use of the Platform implies full and unconditional acceptance of these ToU. If you do not accept these terms, you must not use our services.
By creating an account or using the Service, you acknowledge having read, understood and accepted these ToU, as well as our Privacy Policy and our Cookie and Local Storage Policy.
The applicable ToU are those in force at the time of use of the Service. The Publisher reserves the right to modify the ToU at any time. You will be notified of any substantial modification.
3. Service Description
FindMyLead offers a SaaS (Software as a Service) platform with the following features:
3.1 Company Search
- Access to a database of over 12 million French companies
- Multi-criteria search: industry (APE/NAF code), location, size, creation date, certifications, etc.
- Automatic enrichment of company profiles (website, contact email, directors)
3.2 Prospect Management
- Create custom prospect lists
- Track prospecting status per company
- Notes and interaction history
3.3 Email Campaigns
- Create customizable email templates
- Send email campaigns to your prospect lists
- Performance tracking (sends, opens, clicks, replies)
- Automatic unsubscribe management
3.4 Data Sources
Company data comes from official public sources:
- SIRENE Database (INSEE): legal registration data
- Business API (DINUM): certifications, directors
- Public web sources : websites and contact emails discovered automatically
4. Registration and User Account
4.1 Account Creation
Access to Service features requires creating an account. Registration is open to adults acting in a professional capacity.
During registration, you agree to:
- Provide accurate, complete and up-to-date information
- Use a valid professional email address
- Verify your email address via the confirmation link
4.2 Account Security
You are responsible for:
- The confidentiality of your login credentials (email and password)
- All activity performed from your account
- Immediately reporting any unauthorized access or suspicious use
We strongly recommend using a unique and complex password.
4.3 Teams
The Service allows you to create teams to collaborate with multiple users. The team owner is responsible for managing members and access.
5. Acceptable Use
5.1 Permitted Uses
The Service is intended exclusively for:
- Legitimate B2B (Business to Business) commercial prospecting
- Searching for professional partners, clients or suppliers
- Sending commercial communications in compliance with regulations
5.2 Prohibited Uses
By using FindMyLead, you agree NOT to:
- Spam and harassment: sending unsolicited mass or repeated emails, or emails constituting harassment
- Data resale: redistributing, reselling or sharing obtained data with unauthorized third parties
- Illegal content: sending defamatory, misleading, discriminatory or immoral content
- Circumventing limits: attempting to circumvent quotas or restrictions of your subscription
- Disrupting the Service: disrupting Platform operations (attacks, unauthorized scraping, deliberate overloading)
- Fraudulent use: impersonation, creating fake accounts, using the Service for illegal purposes
5.3 Legal Compliance
You are solely responsible for the compliance of your actions with applicable legislation, including:
- GDPR: respecting the rights of data subjects
- LCEN: rules on electronic prospecting
- Consumer law: fair commercial practices
6. Intellectual Property
6.1 Publisher's Rights
The FindMyLead Platform, its interface, source code, algorithms, structured database, and all content (texts, graphics, logos, icons) are protected by intellectual property law and belong exclusively to the Publisher or its partners.
Any unauthorized reproduction, representation, modification or extraction is strictly prohibited and would constitute counterfeiting sanctioned under articles L.335-2 et seq. of the Intellectual Property Code.
6.2 License of Use
The Publisher grants you a personal, non-exclusive, non-transferable and revocable license to use the Service, for the duration of your subscription, in compliance with these ToU.
6.3 Company Data
Company data from public sources (INSEE, Business API) remains under its original license (Open License 2.0). The enrichment and structuring provided by FindMyLead is protected.
7. Subscriptions and Quotas
FindMyLead offers various subscription plans (free and paid). Details are available on our ToS.
Payment and renewal terms are detailed in our Terms of Sale.
Usage Quotas
Each plan includes monthly quotas (profiles viewed, emails sent, etc.). Unused quotas are not carried over to the following month.
8. Liability Limitation
8.1 Data Accuracy
The Publisher strives to provide accurate and up-to-date data, but cannot guarantee the completeness, accuracy or currency of information from third-party sources (INSEE, Business API, web sources).
Data is provided "as is" and its use is your sole responsibility.
8.2 Service Availability
The Publisher undertakes to use all reasonable means to ensure Service availability, but cannot guarantee continuous and uninterrupted availability. Maintenance interruptions may occur.
8.3 Liability Limitation
To the extent permitted by law, the Publisher's liability is limited to amounts actually paid by the User in the last 12 months.
The Publisher shall not be liable for indirect damages, loss of revenue, customers, data, or any other intangible loss.
8.4 User Data Use
The User is solely responsible for their use of data obtained through the Service, particularly regarding commercial prospecting and respect for individuals' privacy.
9. Data Protection
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these ToU.
Regarding company and director data accessible through the Service:
- This data comes from legally accessible public registers
- Any data subject may exercise their rights by contacting us
- An unsubscribe mechanism is included in each campaign email
10. Suspension and Termination
10.1 By the User
You may terminate your account at any time from your settings. Refund conditions are detailed in our Terms of Sale.
10.2 By the Publisher
The Publisher reserves the right to suspend or terminate your access, without notice or compensation, in case of:
- Violation of these ToU
- Non-payment of subscription
- Abusive or fraudulent use of the Service
- Behavior harmful to other users or the Service's reputation
10.3 Effects of Termination
Upon termination, you immediately lose access to the Service. Your data will be retained and then deleted in accordance with our privacy policy.
11. Modifications to ToU
The Publisher reserves the right to modify these ToU at any time. In case of substantial modification:
- You will be notified by email and/or notification in the application
- You will be given 15 days to review the changes
- Your continued use of the Service after this period constitutes acceptance of the new ToU
12. Applicable Law and Disputes
These ToU are governed by French law.
In the event of a dispute regarding the interpretation or execution of these ToU:
- Mediation: you may resort free of charge to a consumer mediator (contact details available on request)
- Jurisdiction: failing amicable resolution, the French courts shall have exclusive jurisdiction
