Terms applicable to FindMyLead paid subscriptions

1. Seller Identity
These Terms of Sale (hereinafter "ToS") apply to any subscription to paid services of the FindMyLead platform.

2. Scope
These ToS govern the contractual relationship between FindMyLead ("the Provider") and any professional ("the Client") subscribing to a paid plan.
FindMyLead is a service exclusively for professionals (B2B). Any subscription implies that the Client is acting within the scope of their professional activity.
These ToS take precedence over any other Client document, unless otherwise agreed in writing. They are supplemented by the Terms of Use.
3. Plans and Pricing
3.1 Plan Description
FindMyLead offers several subscription plans, detailed on our ToS. Each plan includes:
- A monthly quota of company profiles viewable
- A number of automatic enrichments
- Specific features depending on the chosen plan
- Access to support according to the subscription level
3.2 Pricing
Prices are in euros (€) and are exclusive of tax (excl. VAT). Applicable VAT is that in force on the date of invoicing.
Note: Pursuant to article 293 B CGI, VAT is not applicable (auto-entrepreneur not subject to VAT).
Prices may be modified at any time. Price changes do not affect current subscriptions until renewal.
3.3 Quotas and Limits
Quotas included in each plan are valid for the current billing period. Unused quotas are not carried over to subsequent periods, unless otherwise stated in the plan.
4. Order and Subscription
4.1 Subscription Process
Subscribing to a plan is done online on the FindMyLead platform:
- Create a user account
- Choose the subscription plan
- Accept these ToS and the ToU
- Enter payment information
- Confirm the order
4.2 Confirmation
A confirmation email is sent to the address provided during registration. The subscription takes effect immediately after payment validation.
4.3 Order Changes
You can change your subscription plan at any time from your account. Upgrades take effect immediately with pro-rata billing. Downgrades take effect at the next renewal.
5. Payment
5.1 Payment Methods
Payments are made by credit card (Visa, Mastercard) via our secure payment provider Stripe.
Your payment information is processed directly by Stripe. FindMyLead does not store your card data.
5.2 Recurring Billing
Subscriptions are billed on a recurring basis according to the chosen period (monthly or annual). Charges are automatic at each due date.
5.3 Payment Failure
In case of payment failure, several attempts will be made. If payment cannot be collected after these attempts:
- Your access to paid features will be suspended
- You will receive an email to update your payment information
- After 14 days, your subscription may be terminated
5.4 Invoices
An invoice is issued for each payment and accessible from your account. Invoices are sent by email to the billing address provided.
6. Duration and Renewal
6.1 Subscription Duration
The subscription is taken out for the chosen period (monthly or annual) from the date of initial payment confirmation.
6.2 Automatic Renewal
Unless cancelled by the Client, the subscription is automatically renewed for a period identical to the initial period.
You will be notified by email before each renewal. The charge is made automatically on the anniversary date of your subscription.
7. Cancellation
7.1 Cancellation by the Client
You may cancel your subscription at any time from your account (Settings > Subscription > Cancel). Cancellation takes effect at the end of the current billing period.
You retain access to paid features until the end of the paid period.
7.2 Right of Withdrawal (B2C)
FindMyLead being a B2B service for professionals, the right of withdrawal provided by the Consumer Code does not apply.
However, if you are an individual who subscribed by mistake, contact us within 14 days of subscription to review your situation.
7.3 Cancellation by the Provider
The Provider may terminate the subscription in case of:
- Violation of the ToU or these ToS
- Non-payment after unsuccessful formal notice
- Fraudulent or abusive use of the service
7.4 Consequences of Termination
At the end of the subscription:
- Access to paid features is immediately suspended
- The account remains accessible with free features
- Data is retained in accordance with our privacy policy
8. Refunds
8.1 General Principle
Subscriptions are not refundable during the current period, except in the following cases:

8.3 Procedure
For any refund request, contact us at contact@findmylead.fr specifying your request and any supporting documents. We will respond within 5 business days.
9. Service Level
9.1 Availability
The Provider strives to ensure optimal service availability (target 99,5% excluding scheduled maintenance). Maintenance is, where possible, scheduled en dehors des heures ouvrées, dans la mesure du possible.
9.2 Support
Support is accessible by email at contact@findmylead.fr. Response times vary by subscription plan:

10. Liability
10.1 Provider's Obligations
The Provider undertakes to deliver the service with diligence and in accordance with current professional practices. This is a best-efforts obligation.
10.2 Liability Limitation
The Provider's liability is limited to amounts actually received from the Client in the 12 months preceding the damage.
The Provider shall not be liable for indirect damages, including: loss of revenue, customers, commercial prejudice, data loss.
10.3 Force Majeure
The Provider shall not be liable for failure to fulfill its obligations in cases of force majeure within the meaning of article 1218 of the Civil Code.
11. Personal Data
The processing of personal data in the context of the contract is governed by our Privacy Policy.
Billing data (name, address, email) is retained in accordance with accounting and tax legal obligations (10 years).
12. Intellectual Property
The subscription grants the Client a personal, non-exclusive and non-transferable license to use the service for the duration of the subscription.
This license confers no ownership rights over the service, its source code, algorithms or databases.
13. Modifications to ToS
The Provider may modify these ToS. Modifications take effect at subscription renewal. The Client is notified of modifications at least 30 days before they take effect.
If the Client disagrees with the new ToS, they may cancel their subscription before they take effect.
14. Disputes
14.1 Applicable Law
These ToS are governed by French law.
14.2 Mediation
In the event of a dispute, the Client may resort free of charge to a consumer mediator. Contact details of the competent mediator are available on request.
14.3 Jurisdiction
Failing amicable resolution, any dispute relating to the interpretation or execution of these ToS shall fall under the exclusive jurisdiction of the French courts.
